MaltaVista Terms & Conditions

These Terms and Conditions apply to the services that are provided directly or through third parties on the website MaltaVista.com (Website), owned and operated by MaltaVista, registered at ODTÜ Teknokent Bilişim İnovasyon Merkezi – Mustafa Kemal Mahallesi – Dumlupınar Bulvarı – 280 / G Zemin Kat – Ankara – Turkey. Using this Website, visitors and users (User or Users) can book language courses, accommodation and other travel services (Travel Services) from language schools and other service providers (Service Provider). MaltaVista provides a platform for finding language courses and for booking Travel Services. MaltaVista provides the Website, but does not provide the Travel Services.

1. Using this website

When using the Website, User hereby agrees with these Terms and Conditions (Terms). These Terms constitute the agreement between MaltaVista and User. By visiting Website and booking Travel Services, User agrees to these Terms. The Terms and Conditions for the provision of the Travel Services are governed by individual terms and conditions of the Service Providers (Service Provider Terms) and are not controlled, influenced, edited, monitored, or updated by MaltaVista. When booking Travel Services, User enters into a contractual relationship with a particular Service Provider. When booking or purchasing the Travel Services, User agrees to read and comply with Service Provider Terms, including the terms and conditions for changing or canceling bookings of specific language schools or accommodations that have been booked. When booking or purchasing Travel Services, MaltaVista. acts as an intermediary between User and Service Provider. MaltaVista does not provide Travel Services and is not responsible for the actions or omissions of any of our Service Providers. Notwithstanding the foregoing, MaltaVista provides assistance to ensure communication with Service Providers and to resolve disputes with Service Providers, in case of such a situation. MaltaVista places materials on Website that are provided by Service Providers. MaltaVista takes all possible measures to post the most complete, up-to-date, and relevant information. However, MaltaVista cannot guarantee the accuracy of the materials provided by the Service Providers. When booking Travel Services, Users shall go to the Service Provider’s website to familiarize themselves with all the information, terms and conditions of booking, changing and canceling of Service Provider. MaltaVista has the right to change these Terms at any time and at its sole discretion. The amended Terms come into full force and effect from the moment they are published on the Website. It is User responsibility to monitor these Terms for changes, updates, and other such modifications. If User have questions about the Travel Services or any other questions, they can contact a representative of MaltaVista through a personal account on the Website or email on hello@MaltaVista.com.

2. Before you book:

2.1 Insurance

We strongly advise all Users to take out insurance in case of the need to return home early, a medical condition arises, and/or other unpredictable circumstances outside of MaltaVista’s control. User undertakes to independently verify the need to purchase insurance, read the insurance conditions, and purchase insurance at their own expense.

2.2 Health declaration

If Users have any illnesses, allergy or disability, this must be reported to the service providers at the time of confirmation of the booking.

2.3 Visa approval

It is the responsibility of the User to arrange all applicable travel permits or visas and to have a valid passport. MaltaVista in User’s account reminds User of the need to apply for a visa. Visa regulations change from time to time and without advance, direct notice to Users. Therefore, MaltaVista strongly advises Users to contact their relevant embassy/consulate in their country for up to date information.

3. Reservation application

The “Book ” button will take you through a very quick, user-friendly online application system where you enter your personal data and select a payment method. Once a language school and/or host has been chosen by User and a deposit has been paid through the Website, the Service Provider will confirm availability of the services you require. Once the school confirms availability for those services, User will receive a confirmation email. Upon receipt of a confirmation letter, the User must verify the accuracy of the booking details. In the event of erroneous or inaccurate data, the User shall immediately contact a representative of MaltaVista through their personal account on the Website or email on hello@MaltaVista.com. By making a booking with Service Providers through Website, User agrees with the relevant particular Service Provider Terms and other additional conditions that may apply to booking or staying at a chosen school. User agrees to familiarize themselves with the particular Service Provider Terms on the Website on the page of the selected language school, as well as in a letter confirming the reservation. The User’s booking is considered confirmed only after making a deposit and receiving a confirmation letter. A letter of enrollment in the course is sent only after deposit is paid. When booking, the cost of the trip is fixed in the school’s national currency. MaltaVista does not set a payment currency exchange rate. The currency exchange rate is set by the bank that issued the User’s card, or set at the rate of the payment system, depending on the payment method selected. The User undertakes to pay all expenses for a bank transfer and any fees of their bank (including currency exchange) or any costs associated with paying a credit card so that the recipient receives full payment to their account. The payment date is the date the payment is received in the beneficiary’s bank account. Users required to be in possession of a visa to enter a country or territory should book the course and accommodation at least 6 to 8 weeks in advance. No flight ticket should be purchased until MaltaVista confirms the User’s place in the Language school and/or accommodation. You are obliged to keep us and the service providers informed of any changes of address, your personal contact details, and emergency contacts details. If User has any questions regarding their booking, they can contact a representative of MaltaVista through a personal account on the Website or email them on hello@MaltaVista.com.

4. Cancellations and refunds

4.1 Cancellation or change of booking by User

Cancellation conditions after confirmation or enrollment in the school are determined by the rules of a particular Service Provider and are associated with other additional conditions that may apply to booking or staying at the school. To determine the specific conditions for canceling a reservation, the User must familiarize themselves with Service Provider terms. While refunds are remitted in Euro (€), the refund amount may be converted into the currency of User’s bank account at the rate of User’s bank, if the currency of User’s account is different from Euro (€). Refunds are made only to the card. The term for crediting funds may take from five (5) to thirty (30) banking days, and depends on the conditions of the User’s bank. If User changes the booking conditions, such as the course date, then the changes are determined in accordance with the rules of the Service Provider. Cancellations, changes, or the need to clarify User’s personal data for Service Providers or MaltaVista may be completed in the User’s personal account on Website.

4.2 Cancellation by the service providers

Occasionally, the Service Providers have to make changes to and correct errors in brochures and other advertising media both before and after bookings have been confirmed, and cancel confirmed bookings. Most of the changes are minor, which do not affect the course date, venue, or course cost. If the Service Provider makes a significant change (for example, changes the course date or course price) or cancels the booking completely, then MaltaVista will notify the User about such changes within 1-3 business days to the email address provided by the User. In case of cancellation of the reservation by the Service Provider, the full payment for the reservation is returned in accordance with the rules of the Service Provider and Section 4.1 If and when time permits prior to departure, we will offer Users the choice of the following options: (i) for significant changes, such as a change of school or course dates, Users can accept the changed arrangements; or (ii) purchase an alternative course from us, of a similar standard to that originally booked if available, and if the chosen alternative is less expensive than your original one, we will refund the difference; however if it is more expensive, we will ask you to pay the difference; or (iii) cancel or accept the cancellation, in which case you will receive a refund according to Service Provider’s terms and conditions. Refunds are made in accordance with Section 4.1 Please note, the above options are not available where any change made is a minor one (e.g. situations where no changes of school or course dates are needed). In this case, booking is not considered cancelled by the Service Provider. If your reservation has been canceled by the Service Provider, Users will receive an email confirming your cancellation. If Users do not receive the cancellation email, please check a spam/junk folder. If Users have not received a cancellation email in their inbox or spam/junk folder, Users shall contact MaltaVista through User’s account or email on hello@MaltaVista.com.

4.3 Cancellation due to visa refusal

If User has been refused a visa, User must inform MaltaVista immediately. In the event of visa refusal into the country where User has booked their course, official documentation of the application refusal and original documents from the language school (Letter of Acceptance) must be emailed to hello@MaltaVista.com before any refunds can be considered. No refund of any amount will be issued where original documents have not been received. When a refund is to be issued due to visa refusal, the full course and accommodation fees will be refunded in accordance with Section 4.1, less bank and/or credit card charges. Please note each school has their own visa refusal cancelation policy and some fees may be charged by the language school in this event. Some Service Providers do not refund is case of visa rejection. Service Providers refunding a deposit in the event of a visa rejection are specially marked: «Refund in case of visa rejection». You can find the full visa refusal policy of the school in the school profile on the Website. MaltaVista nor the service providers will not issue any refund where: a) visa has been previously refused; b) visa is refused and/or cancelled due to poor attendance or non-attendance; c) the relevant Home Office, Embassy, Consulate or port of Entry immigration officials believe that you are not a bona fide or genuine student and subsequently refuses visa and/or entry to the country where you book your course/accommodation; d) student leaves the country of the chosen school during the course and is denied re-entry; e) appeal is pending; and f) any information was falsified.

5. Termination policy

Termination means stopping or leaving all or part of the course and/or accommodation once the course has started. Please see the specific terms of the Service Providers you have selected prior to booking a course as you will be bound by these specific terms and conditions once you confirm the booking. Service Providers might ask Student for a reason for cancellation and supporting documents.

6. Public holidays

Classes are not held and most language school facilities are closed on public holidays. Most published courses start on Monday, if Monday is public holiday classes will start on Tuesday, unless stated otherwise in Provider’s terms and conditions. In the case of cancellation of classes due to public holidays or the decision of the government of the country, Service Provider is located, on non-working days, the postponement or cancellation of classes depends on the Provider Terms.

7. Arranged pick up transfer

If you have booked a pick up and/or drop off service you must provide your exact flight details at least 1 weeks prior to your arrival in your account on the Website. You should look for a driver in the arrival hall holding a sign with your name printed on the sign. If your flight was late or cancelled you should immediately contact the Provider on the phone number provided in the transfer confirmation. If you can’t find your driver and you decide to leave without contacting the service providers you will not be entitled to a refund. You must call service providers in case you can’t find your driver before you decide to take alternative transport.

8. Accommodation

When booking accommodation on the Website, the User agrees to the Terms of the Service Provider. If User cancels or changes the accommodation dates, the Service Provider may withhold a fine in accordance with their Terms. The amount of the fine depends on the Service Provider Terms and will be indicated in the User’s personal account on the Website. The language school and their providers provide accommodation if students book a full time course for the same period. Any such deposits which may be required for some types of accommodation, will be required at the time of booking and returned at the end of the rental period on the condition that there is no damage to the property. MaltaVista is not responsible for the quality of the accommodation provided, as well as for the actions or inaction of the school or Service Provider.

9. Confidentiality

MaltaVista takes care of the confidentiality of Users personal data. The policy for processing and protecting personal data is set forth in the Privacy Policy.

10. Liability

MaltaVista, as well as its subsidiaries, affiliates, officers, agents, shareholders, directors, employees, partners, licensors or other persons involved in the creation, sponsorship, promotion or other provision of the Website are not responsible for any claims, damage, losses or expenses, including attorney’s fees and expenses incurred by the User in connection with (i) any action or inaction of the Service Provider, (ii) any mistake of the User, as well as other action or inaction on the part of the User, (iii) violation by the User of these Terms, any rules of the Service Provider, (iv) any act or omission of third parties independent of MaltaVista In the event of a liability with MaltaVista, the amount of liability of MaltaVista must not exceed the fee of MaltaVista for a specific service paid by the User at MaltaVista MaltaVista is not responsible for any actions or omissions of the Service Provider, for the provision of the Travel Services and Service Providers Terms.

11. Force Majeure

MaltaVista is not considered to have violated any provision of these Terms and is not responsible for delays, non-fulfillment or interruption of services caused directly or indirectly by natural disasters, decisions of any authorities, civil unrest, war, terrorism, strikes, fires, pandemics, epidemics or other disasters power outages or telecommunications, or any other reason beyond the control of MaltaVista, which are recognized as force majeure circumstances.

12. Applicable law and dispute resolution

These Terms are governed by and construed in accordance with the laws of the Turkey without reference to any principles of conflicts of laws, which might cause the application of the laws of another state. These Terms are not subject to consumer protection laws in any other countries. In the event of any dispute arising from or in connection with these Terms, the parties shall endeavor to resolve the dispute within thirty (30) days from the date of its occurrence. The parties act in good faith to resolve such a dispute through negotiations. If the dispute cannot be resolved through negotiations within thirty (30) days after sending the corresponding written request to hello@MaltaVista.com, then such a dispute is referred to and finally resolved by a court of the Cankaya, Ankara (Turkey). Each party unconditionally agrees that the state courts of Turkey will have exclusive jurisdiction to resolve any disputes or claims between the parties arising out of or in connection with this agreement, its subject matter or conclusion (including non-contractual disputes or claims).

This Website may contain hyperlinks to websites operated by parties other than MaltaVista Such hyperlinks are provided for your reference only, in order to offer you an additional facility of this site. MaltaVista does not control such websites and is not responsible for their contents or links included on these pages, which are protected by third party copyright. The inclusion of hyperlinks on this website to such other websites does not imply any endorsement of the material on such websites or any association with their operators.

14. Intellectual Property Rights

The intellectual property contained on the Website and in the services is the proprietary information of MaltaVista, our affiliates or Service Providers and is protected by copyright and other intellectual property rights. All property rights and intellectual property rights in relation to the Website and services remain with MaltaVista, our affiliates or Service Providers, as the case may be. All rights not claimed under the Terms or MaltaVista are hereby reserved by MaltaVista Website and the Travel Services are protected by copyright, trademarks (registered or being registered), service marks, patents or other property rights and laws (“intellectual property”). Any use of intellectual property without the permission of MaltaVista is prohibited.

15. The language of these Terms and Conditions

The original English version of these terms and conditions may have been translated into other languages. The translated version is a courtesy and office translation only and you cannot derive any rights from the translated version. In the event of a dispute about the contents or interpretation of these terms and conditions or inconsistency or discrepancy between the English version and any other language version of these terms and conditions, the English language version to the extent permitted by law shall apply, prevail and be conclusive. The English version is available on the Website or shall be sent to you upon your written request on hello@MaltaVista.com.

16. Other provisions

MaltaVista reserves the right to change the Website, suspend or terminate the Website at any time for any reason with or without notice. MaltaVista reserves the right to transfer its obligations under these Terms to any individual or legal entity.
